遇警臨檢有疑慮　製作異議記錄事後求償

路上遇警臨檢竟被脫光搜身，律師張建鳴提醒，警員臨檢僅可查驗民眾身分，除非有明顯犯罪事實，或足認民眾攜帶傷害他人或自己的物品才能搜身，但民眾可對警方搜索提出異議，並請警員製作「警察行使職權民眾異議紀錄表」保障權益，建議民眾遇檢時配合警方要求，避免肢體衝突、言語辱罵，以免觸犯妨害公務等罪。

警政署行政組也表示，警員攔車後若目視有明顯犯罪行為，才可逕行搜索人車，過程須以ＤＶ、密錄器錄影蒐證，並有警員在旁戒護。

張建鳴指出，警察臨檢須穿制服或出示證件，並告知事由，民眾則須配合出示證件，若無法證實身分，可能被帶回警局調查，但不得逾三小時；若警員未明確告知臨檢事由，民眾可拒絕要求。此外，若無明顯犯罪事證，警方搜車、搜身均須經民眾同意，但若行經設立酒測執行告示的路檢點，民眾就須停車接受臨檢，否則會被處九萬元罰鍰。（張君豪、王雅慧／台北報導）
